Data Protection Policy

This Data Protection Policy governs the collection, use and disclosure of personal data submitted to VisualSoft Corporate Services Pte. Ltd. (referred to herein as the “VSCS”, “us”, “we” or “our”) including through our websites and explains how we collect and handle personal data of individuals and comply with the requirements of the Personal Data Protection Act 2012 of Singapore and its regulation(s) (“PDPA”). In this policy, “personal data” shall have the meaning ascribed to it in the PDPA.

We will collect, use or disclose personal data for reasonable business purposes only if there is consent or deemed consent from the individual and information on such purposes have been notified. We may also collect, use or disclose personal data if it is required or authorised under applicable laws.

This Data Protection Policy supplements but does not supersede nor replace any other consent you may have previously provided to VSCS in respect of your Personal Data, and your consent herein are additional to any rights which VSCS may have at law to collect, use or disclose your Personal Data.

We may from time to time update this Data Protection Policy to ensure that this Data Protection Policy is consistent with our future developments, industry trends, and/or any changes in legal or regulatory requirements. Subject to your rights at law, you agree to be bound by the prevailing terms of this Data Protection Policy as updated from time to time on our websites, applications, and digital services. 1. Collection of Personal Data

We collect personal data from clients, customers, business contacts, partners, personnel, contractors and other individuals. Such personal data may be provided to us in forms filled out by individuals, face to face meetings, email messages, telephone conversations, through our websites or provided by third parties. If any individuals contact us, we may keep a record of that contact.

We collect these personal data when it is necessary for business purposes or to meet the purposes for which the individuals have submitted the information.

We will only collect, hold, process, use, communicate and/or disclose such personal data, in accordance with this policy. If any party is acting as an intermediary or otherwise on behalf of a third party individual or supplying us with information regarding a third party individual (such as a friend, a colleague, an employee etc), such intermediary party undertakes that you are an authorised representative or agent of such third party individual and that you have obtained all necessary consents from such third party individual to the collection, processing, use and disclosure by us of their personal data. Because we are collecting the third party individual’s data from you, you undertake to make the third party individual aware of all matters listed in this policy preferably by distributing a copy of this policy to them or by referring them to our website.

2. Purposes for the Collection, Use and Disclosure of Your Personal Data

We collect, use and disclose your personal data for any or all of the following purposes:

  • to provide our services e.g. corporate secretarial services; statutory compliances; corporate advisory etc.
  • to verify your identity
  • to respond to the individual’s request or for the purposes for which it was provided to us as stated at the time of the collection (or as is obvious from the context of collection)
  • to maintain contact with clients and other contacts
  • to keep clients and other contacts informed of the services we offer, industry developments, service offerings, seminars and other events we are holding, that may be of interest to them
  • for management and reporting purposes, such as invoicing
  • for compliance with any applicable laws, regulations, codes of practice, guidelines, or requirements or to assist in law enforcement and investigations conducted any governmental and/or regulatory authority
  • for recruitment purposes
  • for purposes related to the employment of our personnel and providing internal services to our personnel
  • any other incidental business purposes related to or in connection with the above.

3. Disclosure of Personal Data to Third Parties

We do not disclose personal data to third parties except when required by law, when we have the individual’s consent or deemed consent or in cases where we have engaged third parties such as data intermediaries, subcontractors, or agents specifically to assist with our firm’s activities. Any such third parties whom we engage will be bound contractually to keep all information confidential.

We may disclose personal data to other member firms, where it is necessary (i) to meet the purpose for which such individual has submitted the information; or (ii) to enable such individual to be provided with information at a later date which may be of relevance and interest to such individual based on the nature and purpose of such individual’s voluntary requests.

We may also transfer all data in our possession to a successor-in-interest to our business or assets.

4. Security and Protection of Personal Data

We will take reasonable efforts to protect personal data in our possession or our control by making reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks. However, we cannot completely guarantee the security of any Personal Data we may have collected from or about you, or that for example no harmful code will enter our websites, applications, and digital services (for example viruses, bugs, trojan horses, spyware or adware). You should be aware of the risks associated with using websites, applications, and digital services.

While we strive to protect your personal data, we cannot ensure the security of the information you transmit to us via the Internet, when you browse our websites, or use our applications and/or digital services, and the method of electronic storage. We urge you to take every precaution to protect your personal data when you are on the Internet, when you browse our websites, or use our applications and/or digital services. We recommend that you change your passwords often, use a combination of letters and numbers, and ensure that you use a secure browser.

5. Accuracy of Personal Data

We generally rely on personal data provided by you (or your authorised representative). In order to ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing us in writing or via email at the contact details provided below.

6. Transfer of Personal Data outside of Singapore

We will ensure that any transfers of personal data to a territory outside of Singapore will be in accordance with the PDPA so as to ensure a standard of protection to personal data so transferred that is comparable to the protection under the PDPA.

7. Privacy on Our Website

This Policy also applies to any personal data we collect via our website. Cookies may be used on some pages of our website. A cookie is a small piece of information that is placed on your computer when you visit certain websites. The cookies placed by the servers hosting our websites are readable only by us, and cookies cannot access, read or modify any other data on an electric device, nor does it capture any data which allows us to identify you individually. All web-browsers offer the option to refuse any cookie, and if you refuse our cookie then we do not gather any information on that visitor. Should you wish to disable the cookies associated with these browsers, you may do so by changing the setting on your browser. However, you may not be able to enter certain part(s) of our websites.

Because we want visitors’ website experience to be as informative and resourceful as possible, we may provide a number of links to third party websites. We assume no responsibility for the information practices of these third party websites that visitors are able to access through ours. When a visitor to our website links to these third party websites, our privacy practices no longer apply. We encourage visitors to review each website’s privacy policy before disclosing any data.

8. Feedback, Withdrawal of Consent, Access and Correction of Your Personal Data

  2. would like to withdraw your consent to any use of your personal data as set out in this Data Protection Policy; or

We will try to respond to your question or request promptly. We may however, depending on the nature of the question or request, need up to 4 weeks to provide you an estimate of when we will be able to respond to you.

For a request to access your personal data, we may charge a fee in accordance with the requirements of the PDPA.

For a request to withdrawal your consent, we will upon receipt of your written request and for your request to be processed, inform you of the likely consequences of withdrawing your consent. We will cease (and cause any of our data intermediaries and agents to cease) collecting, using or disclosing the personal data unless it is required or authorised under applicable laws.

9. Retention of Personal Data

We will cease to retain your personal data, as soon as it is reasonable to assume that the purpose for collection of your personal data is no longer being served by such retention, and such retention is no longer necessary for legal or business purposes.
